In today's episode, we discussed the penalties for failure to file the ISF 5+2 on time. The ISF 5+2 is an electronic form that must be filed with CBP at least 24 hours before the vessel departs from the foreign port. If the ISF 5+2 is not filed on time, several penalties can be imposed by CBP.
The first penalty is the late filing penalty, which can range from $5,000 to $10,000 per shipment. This penalty is imposed if the ISF 5+2 is not filed within the required timeframe. The second penalty is the inaccurate, incomplete, or untimely filing penalty. CBP can impose this penalty if the filed ISF 5+2 is deemed inaccurate, incomplete, or not filed within the required timeframe. The amount of this penalty can reach up to $5,000 per shipment.
Failure to file the ISF 5+2 on time can also result in cargo hold and examination. CBP has the authority to place a hold on the shipment until the required information is provided. CBP may also conduct a physical examination of the shipment, leading to potential delays and additional costs.
Lastly, failure to comply with ISF filing requirements may increase the risk of seizure of the goods. CBP can seize any goods that are unmanifested or not properly declared. Seizure can result in significant financial loss and legal consequences.
