ACLJ Files Major Brief Against Fani Willis

Today, the ACLJ legal team filed a major brief in DA Fani Willis’ case against former President Donald Trump to disqualify DA Willis and protect the integrity of our judicial system. Judge Scott McAfee refused to remove Fani Willis, who campaigned on prosecuting Trump, even after ruling that an “odor of mendacity” – lying – hung over the case.
While Judge McAfee allowed Willis to stay on the case if Special Prosecutor Nathan Wade was removed, his language was condemning. Many things he touched on suggested a conflict of interest, or at the least an appearance of a conflict. So how can we expect impartiality in this case?
As we stated in our amicus brief:
The existence of a conflict of interest, including an apparent conflict, is an issue of such structural magnitude that it affects the entirety of a criminal proceeding. A conflicted prosecutor who nonetheless proceeds with prosecution casts an “odor of mendacity” over an entire proceeding that cannot be corrected or remedied after the fact. Beyond its unconstitutionally injurious impact on the Defendants, the odor negatively impacts the public’s perception of and confidence in the judicial system—especially when the prosecution is that of a leading national candidate for the highest office in the land.
Our filing was critical because the implications of the case are much broader than President Trump. The brief explains:
Millions of Americans from the other forty-nine states who have no ability to influence Georgia’s local political conduct are watching this case and will be directly affected by its outcome. The bad choices, prejudices, and personal political motivations of Fulton County’s District Attorney, and the Georgia judiciary’s response thereto, impact the entire nation. The integrity of Georgia’s criminal justice system—implicating its prosecutors and its courts—is at stake.
We want to preserve the integrity of the judicial system. The American people should not trust this prosecution and should see it as the far Left interfering with the election. The Georgia Court of Appeals should disqualify DA Willis.
