Lawfare: Expert Legal Analysis On The Case Against Trump | Ep 215

Jed Rubenfeld is a professor at Yale Law School and an expert in constitutional law. He is with me today to given an expert analysis on the lawfare used against President Trump. We discuss the case in length, sentencing and the appellate process.

In one of the most momentous cases of our time, a former president was convicted of a crime that few understand. The jury was given options as to what President Trump may have been guilty of in a novel legal theory that violates the 6th amendment of the Constitution. This convoluted case included additional crimes that were never clearly explained all the way up to the day of trial. While the Manhattan DA's office run by Alvin Bragg has been consistently reducing felonies to misdemeanors, this was a misdemeanor elevated to a felony by allegedly misreporting invoices, checks and ledger entries in order to conceal 34 payments made. Unironically, Hillary Clinton's campaign had recorded business records as legal expenses in the famous Steele Dossier to which she only received a fine. Bragg ran for election to "Get Trump," Judge Merchan contributed to "Stop Republicans" and Michael Colangelo left the Biden administration to join the prosecution in this case. What they have done collectively is taken lawfare to an ugly extreme and set a dangerous precedent for the future political candidates.
