SHOCKING Developments On Trump Trial Jury Misconduct
Judge Juan Merchan sent a letter to the prosecution and President Trump’s attorneys informing both parties that a posting on the court system’s Facebook page by someone claiming to be a cousin of one of the jurors indicated they’d recieved inside information that Trump would be convicted – prior to the jury reaching a verdict. This revelation raises valid questions of possible jury misconduct and a mistrial in President Trump’s New York trial.
Politico reports on the possible social media blunder:
Justice Juan Merchan informed prosecutors and Donald Trump’s attorneys on Friday about a newly discovered post on the New York court system’s Facebook page from a user who claimed to be the cousin of a juror.
“My cousin is a juror and says Trump is getting convicted,” the user wrote in a week-old comment, according to the judge. “Thank you folks for all your hard work!!!!”
Merchan, who presided over Trump’s recently concluded hush money trial, did not indicate whether the post — which is no longer visible on Facebook — appeared legitimate or may have been the result of a prank.
Imagine you’re Trump’s legal team last Friday night. You’re preparing a motion for a stay on the July 11 sentencing after the outlandish conviction on 34 counts against the former President. And then you get a shocking letter from the judge telling you about the possible social media post that could signal jury misconduct.
Here’s the timeline of what happened. The Facebook comment was posted two days into the jury deliberations and one day before the verdict was announced. The comment was on a post completely unrelated to Trump’s trial on the New York Unified Court System’s Facebook page. Just very bizarre.
What’s even wilder is that no one in the media saw the social post. Neither Fox News nor Newsmax discovered it. It appears that the appellate court division saw the comment and informed Judge Merchan, prompting his letter to both legal parties.
So what should be the result of this development? An investigation must be conducted immediately. And it can be done rather quickly. The post’s authenticity must be determined to ensure it wasn’t some internet troll trying to stir up trouble.
First, the judge should gather all the jurors together again and find out if anybody knows the person (Michael Anderson) who made the post. Of course, since it was an internet posting, one should reasonably doubt that Anderson used his real name.
The court should put all the jurrors under oath and ask if they had any contact with anyone about the case during their deliberations.
If a juror confesses to discussing the verdict, the Trump legal team would have grounds for a mistrial. At the very least, the verdict would be thrown out, and a new trial would take place. What if two or three jurors confessed to discussing the verdict? Then you’re talking about a whole can of worms being opened.
ACLJ Senior Counsel and Director of Policy Harry Hutchison explains the possible jury Facebook post underscores the fact that President Trump was never going to get a fair trial in New York:
This post suggests the impossibility that Donald Trump could, in fact, get a fair trial in New York. That’s number one. Number two: The judge failed to take appropriate safeguards . . . with respect to protecting the jurors from outside influence. . . . [T]he jurors were not sequestered. Their cell phones, as I understand it, were not taken away. Their ability to communicate over the internet was not taken away. [Number three:] The judge likely committed reversible error with respect to the jurors – the jury instructions. Why? Because the judge failed to require that the jurors reach a unanimous verdict with respect to the underlying crime.
Of course, the media immediately dismissed the possibility of jury misconduct via the Facebook post. However, the judge clearly took the matter seriously by sending the letter to the legal teams. We hope the judge gets to the bottom of this matter promptly.
