Bishop Mar Mari Emmanuel Wants Footage Of His Stabbing In Wakeley Church To Stay Online, Court Hears

Bishop Mar Mari Emmanuel, the victim of a stabbing at a church in Wakeley, says footage of his attack should remain online, the federal court has heard.
The court met again on Wednesday to consider a dispute between eSafety commissioner Julie Inman Grant and social media platform X over the attack footage.
Ms Inman Grant last week issued a legal order to take down a few dozen instances of the footage posted on X. But X said it was an overreach to expect the videos to be hidden worldwide.
Lawyers for eSafety then took the matter to court, accusing X of defying its order. On Monday, Justice Geoffrey Kennett issued an injunction ordering X to hide the posts in question temporarily pending further consideration. X did not comply.
But in today's hearing, X lawyer Marcus Hoyne repeated the argument that the global reach of the eSafety commissioner was "exorbitant".
He also argued it was pointless, since footage of the attack had now spread far beyond the few dozen URLs originally identified by the eSafety commissioner.
He suggested this was a case of "Streisand effect", a phenomenon where the attempt to quash something backfires by drawing attention to it.
Mr Hoyne told the court Bishop Emmanuel, the victim of the attack, was "strongly of the view" that the footage should stay online. He said Bishop Emmanuel had provided an affidavit to that effect, which he submitted to the court but which the ABC has not seen. The ABC has contacted Bishop Emmanuel for comment.
He said X believed the eSafety commissioner's original order needed to be reviewed by the Administrative Appeals Tribunal, which can overturn decisions of government officials.
Justice Kennett ordered that the matter be heard again on 10 May, a date when X indicated it would be prepared to make more detailed arguments.
He ordered that his Monday injunction be extended until that date, but did not directly address X's apparent failure to comply with the original injunction.
The injunction applies to the same set of URLs originally identified by the eSafety commissioner, not to any subsequent posts including the footage.
'Whack-a-mole'
The eSafety commissioner has the power to demand the removal of so-called 'class 1 material'.
That includes depictions of violent crime, child sex offences, or other "revolting or abhorrent phenomena [that] offend against the standards of morality, decency and propriety generally accepted by reasonable adults".
But X's resistance has honed in on the question of whether those orders apply to content anywhere in the world, or simply to content visible to Australian users.
X argued it was sufficient to 'geo-block' the URLs, hiding them from Australian users specifically. But lawyers for eSafety argued this could be too easily circumvented by Australians using a Virtual Private Network (VPN), which obscures geographical location, and so global action was required.
But X owner Elon Musk argued this could have broader implications, allowing "any country [to] control the entire Internet?".
Timothy Webb, a tech law specialist at law firm Clayton Utz, said that even if this approach were successful, it would leave the regulator playing "whack-a-mole" with a non-compliant social media platform, since its order covers specific URLs, meaning it would have to keep issuing fresh orders every time a new person shared the same footage.
In a statement, a spokesperson for the eSafety commissioner noted "it may be difficult to eradicate damaging content from the internet entirely, particularly as users continue to repost it."
"eSafety requires platforms to do everything practical and reasonable to minimise the harm it may cause to Australians and the Australian community."

A war of words has broken out between Elon Musk and Anthony Albanese over social media platform X's refusal to censor content from an alleged stabbing incident in Australia, with the outspoken billionaire claiming Labor wanted "authority over all countries on Earth".
The Australian eSafety Commissioner ordered X to remove graphic content depicting vision from the alleged stabbing of a bishop at church in western Sydney on Monday April 15.
The platform hit back, declaring its intentions to launch a legal challenge against what its Global Government Affairs labelled an "unlawful and dangerous approach".
On Monday, Prime Minister Anthony Albanese took aim at X's refusal to censor the content in an attack that caught Musk's attention.
In a post that quoted comments by Mr Albanese on Monday where he said: "By and large, people responded appropriately to the calls by the eSafety Commissioner. X chose not to," Musk replied mockingly.
"I'd like to take a moment to thank the PM for informing the public that this platform is the only truthful one," the billionaire said.
Musk doubled down with another tongue-in-cheek post, sharing an illustration depicting two paths -- one of which claimed X was the path of free speech and truth, and suggested the likes of YouTube, Instagram, Facebook, TikTok, Threads and Reddit represented a dark path of censorship and propaganda -- with the caption: "Don't take my word for it, just ask the Australian PM!"
The Prime Minister returned serve on Tuesday, referring to Musk as "out of touch".
"Well this is a bloke who's chosen ego and showing violence over common sense. I think that Australians will shake their head when they think that this billionaire is prepared to go to court, fighting for the right, to sow division and to show violent videos, which are very distressing," Mr Albanese told Sky News Australia's Peter Stefanovic.
"He is in social media, but he has a social responsibility, in order to have that social licence. And what has occurred here is that the eSafety commissioner has made very sensible suggestions. Other social media companies have complied, without complaint. But this bloke thinks he's above the Australian law, that he's above common decency.
"And I say to Elon Musk that he is so out of touch with what the Australian public want. This has been a distressing time and I find this bloke on the other side of the world, from his billionaires' establishments trying to lecture Australians on free speech – well I won't cop it and Australians won't either."

The war of words followed the Federal Court of Australia on Monday granting a temporary injunction in the favour of eSafety Commissioner Julie Inman Grant, requiring X to remove posts from the alleged stabbing incident.
Lawyers for the eSafety Commissioner, Julie Inman Grant, applied for the injunction after X declared it would fight back her formal directive issued last week.
Justice Kennet allowed X Corp a maximum of 24 hours to hide material identified in Ms Inman Grant's notice from all its global users.
During the injunction, the said posts will be blocked from viewers but not permanently deleted.

A bishop who was allegedly stabbed in the middle of a sermon that was being livestreamed online says that he's doing 'fine' and has forgiven his alleged attacker.
Bishop Mar Mari Emmanuel was preaching at Christ The Good Shepherd Church in Wakeley in Sydney's south-west on Monday night when a 16-year-old boy walked up to the altar before allegedly stabbing him repeatedly.
Bishop Emmanuel was rushed to Liverpool Hospital, where he spent the last few days recovering.
He broke his silence from his hospital bed in a recorded statement released by the church on Thursday morning.
The bishop assured everyone that he was recovering 'very quickly' and that there was no need to be concerned or worried about him.
He also issued a piece of advice in the wake of the riots in the immediate aftermath of the alleged attack, urging everyone to act 'Christ-like'.
'The Lord Jesus never taught us to fight. The Lord Jesus never taught us to retaliate,' Bishop Emmanuel said.
'The Lord Jesus never said to us an eye for an eye and a tooth for a tooth.
'The Lord Jesus said, 'Never return evil with evil but to return evil with good.'
'So my beloveds, I want you to always be calm.
'We need to be always law abiding citizens as well.
'Above all, we are Christians and we need to act like it.'
Bishop Emmanuel thanked the Lord for 'whatever happened to me personally'.
'It's a huge blessing for me,' he said.
The bishop also had a poignant message for his alleged attacker, who also remains in hospital, telling the teen that he has forgiven him.
The teen is yet to be questioned or charged by police.
'I say to him 'You're my son. I love you and I will always pray for you',' Bishop Emmanuel said.
'And whoever sent you to do this, I forgive them as well, in Jesus' mighty name.'
Bishop Emmanuel added that he 'has love for everyone' of all religions.
'The Lord Jesus always told us to love one another.
'Love God, I love your neighbor like yourself. Whoever that neighbor is, we need to love them and respect them as we love and respect ourselves.'
Bishop Emmanuel ended his four minute message by reminding worshippers to reflect Christ in their lives and to respect the law.
'The Lord Jesus never said to go out and fight in the street,' he said.
'He never said to retaliate but pray, which is what I'm asking everyone to do.
'God bless you all, we will see you soon and go back to our normal duties once again in serving the Lord from the heart.'
Father Isaac Royel, who was also injured in the alleged attack, was released from hospital on Wednesday.
A man, 19, was arrested in Doonside in Sydney's west on Wednesday night. Police expect to make more arrests.
Father Daniel Kochou condemned the 'unnecessary and disturbing' actions of rioters in the video message released by the church.
'The unfortunate events which took place outside the church caused unnecessary delays and threats to both victims, paramedics and police,' he said.
'The Church does not condone the activities which took place whereby several persons were injured, property damaged and delays in rendering much-needed assistance.'
