Supreme Court Verdict Could Drop Jack Smith Cases Against Trump

Joseph Fischer, one of the individuals arrested for unlawfully entering the U.S. Capitol in 2021, is facing seven charges. He is contesting the constitutionality of one of these charges: "obstruction of an official proceeding" under 18 U.S. Code Section 1512(c)(2). The crux of the debate revolves around whether this provision specifically pertains to "tampering with evidence." In essence, Fischer argues that he did not violate this law because he did not tamper with evidence in relation to an official proceding.

This issue is significant as two of the charges against President Trump, namely "obstruction of an official proceeding" and "conspiracy to obstruct an official proceeding," are under this category. Should the Justices dismiss these two pivotal charges, Special Counsel Jack Smith's case against Trump would primarily rely on two remaining generic charges: "conspiracy to defraud the U.S." and "conspiracy against rights."
