4/24/24 Update:

As mentioned in the vlog before the judge was to hear both sides’ briefs on hearsay. The judge accepted Vitali’s housemate’s testimony.

MINUTE ORDER as to VITALI GOSSJANKOWSKI: At the evidentiary hearing on April 8, 2024, the government objected to the testimony of Mr. GossJankowski's former housemate, Kyle Sexton, that Mr. GossJankowski made certain statements after returning from the U.S. Capitol on January 6, 2021. The Court provisionally admitted Mr. Sexton's testimony and ordered the parties to brief the hearsay issues involved. After carefully considering the briefs submitted by the parties, the Court will admit Mr. Sexton's testimony in full under Rule 801(d)(1)(B) of the Federal Rules of Evidence for reasons to be explained at the resumed evidentiary hearing on April 26, 2024.
