DACA can Continue, Federal Judge Rules
Affects New EAD, AP and Green Card applicants for DACA.
According to Attorney, DACA Renewals will Continue, Advance Parole will continue. Attorneys recommending to renew EAD and AP sooner than 90days to avoid any future issues.

Biden Administration may challenge this decision in Supreme court.

The Biden administration will move to protect children brought to the U.S. by their migrant parents without the legal right to stay known as Dreamers.

For years, Congress has tried and failed to pass legislation to provide a pathway to citizenship or otherwise address the immigration system. In the absence of legislation, the Obama administration and now, the Biden administration has relied on DACA to ensure the group known as "Dreamers" -- many of whom are now adults -- can stay and work in the US.
As of March 31, there were 616,030 DACA recipients, the majority of whom are from Mexico.

The Biden-Harris Administration continues to take action to protect Dreamers and recognize their contributions to this country," Homeland Security Secretary Alejandro Mayorkas. "This notice of proposed rulemaking is an important step to achieve that goal. However, only Congress can provide permanent protection.

DHS is complying with the July 16, 2021 order issued by the U.S. District Court for the Southern District of Texas, which prohibits DHS from granting initial DACA requests. DHS continues to accept and process DACA renewal requests based on the terms of DACA policy, as permitted by the court’s order. The Biden-Harris Administration has appealed the Texas court ruling. The issuance of the NPRM does not affect the court’s order or DHS’s obligations under the order.
