Nick Rekieta believes that Josh beating Epik is not as much of an open and shut case as people seem to believe it is due to the nature of defamation/per se defamation laws and the actual verbiage used by Epik in their tweets. There is also the matter of who exactly is being defamed (Josh or Kiwi Farms?), exactly how untrue the statements are upon a word by word reading, and estimating how much damage was caused which does matter after winning a per se defamation lawsuit (spending $75,000 to win $1 in damages).
