Is the Israeli killing of Palestinians Justified?

South Africa is accusing Israel of commiting acts of genocide and has brought the issue up at The International Court of Justice. The president of Russia was labeled as a war criminal by the ICC but how does a court consider a countries leader as a war criminal and the other as innocent, where do the lines get unblurred?
