On Wednesday, Former President Donald Trump petitioned the Supreme Court to overturn a Colorado state court decision deeming him ineligible for the state primary ballot due to his actions leading up to the January 6, 2021, attack on the U.S. Capitol.

The Colorado Republican Party had previously filed its own appeal. As per the language in the state court ruling, Trump remains on the Colorado ballot until the Supreme Court makes a decision.

The Colorado Supreme Court, in its December 19 ruling, cited the 14th Amendment of the Constitution, which prohibits individuals who “engaged in insurrection” from running for certain federal offices.

The case introduces unique legal considerations, including whether this provision applies to presidential candidates and who holds the authority to determine whether someone participated in an insurrection, NBC News reported.
