Controversy Surrounds NDAA Provision on Reinstating Unvaccinated Service Members

The legislation, signed into law on Dec. 22, includes a provision that mandates the U.S. military to consider reinstating those who were discharged for refusing the COVID-19 vaccine.
The NDAA requires secretaries of military branches to contemplate reinstating former members who request reinstatement within two years of their separation. However, this move has drawn criticism from retired Army Maj. Charles “Chase” Spears, who emphasizes that it falls short of addressing the concerns of those who were removed. Maj. Spears argues that the provision should compel the Pentagon to reinstate service members rather than leaving it to consideration.
Maj. Grant Smith, a physical therapist with over 13 years of service, echoes this sentiment, stating that Congress needs to be more directive in its approach if it truly intends for former members to be reinstated.
