Did the Butte County State's Attorney Give Incompetent Advice?

At a recent Butte County planning board meeting, during a discussion on what the proper process is to extend the stay of a board member who is not seeking re-election, it seems that the Butte County State's Attorney advised that the said member was able to just stay on without going through the official appointment of the county commission. A sitting planning board member then corrected the State's Attorney. This leaves tax payers like me wondering why we pay people in roles like this a 6 figure salary when they don't seem to know the basics of law and process?
