On July 23, 2021, Aurora police officers John Haubert and Francine Martinez responded to a trespassing call at a church parking lot. Upon arriving, they encountered three men sitting on their bicycles, one of whom was Kyle Vinson, who had a domestic violence warrant. Body camera footage captured Haubert viciously assaulting Vinson, striking him multiple times with his pistol and choking him for approximately 40 seconds. Martinez, who was present during the assault, failed to intervene to stop Haubert's excessive use of force.

Haubert was arrested and charged with second-degree assault, attempted first-degree assault with a deadly weapon, felony menacing, official oppression, and official misconduct. Martinez was also arrested and charged with failure to intervene, a Class 1 misdemeanor.
In November 2021, Haubert resigned from the Aurora Police Department. In April 2022, Martinez was found guilty of failure to intervene. Haubert's trial is ongoing.
