Mr. Thomas, a 35-year-old African-American, and his three passengers were driving in Louisville, Kentucky. They were in a predominantly African-American area. While they were stopped at a traffic light, an unmarked LMPD police cruiser, with Officers Mayo, Robbins, and Flynn, pulled up behind them. After the light changed, the officers followed Mr. Thomas's vehicle and initiated a traffic stop, claiming they observed seatbelt violations through the tinted windows.
Once stopped, multiple officers, including Officer King, the supervisor, arrived on the scene. The officers checked for outstanding warrants and discussed the possibility of searching the vehicle. Officer Mayo repeatedly asked Officer King for permission to remove the vehicle's occupants. Eventually, Officer King gave the go-ahead. All passengers, including Mr. Thomas, were ordered out and positioned at the back of the vehicle for questioning.
Officer Mayo requested Mr. Thomas's consent to search the vehicle multiple times, but Mr. Thomas consistently refused. Despite the refusals, Officer King began searching the vehicle, claiming the presence of an open alcohol container as the reason. The search extended to various parts of the vehicle, and eventually, two vests were found. One vest contained a .380 caliber Remington pistol. Subsequently, Mr. Thomas and his passengers were handcuffed.
