Indiana Code Title 35. Criminal Law and Procedure § 35-49-3-3 section 3
A) covers the majority of the crimes leading to a LEVEL 6 felony dealt as a misdemeanour

Level 6 Felonies:
Level 6 felonies carry a sentence of six months to two and a half years' imprisonment and up to $10,000 in fines. A court can reduce a level 6 felony to a class A misdemeanour under certain circumstances. A person doesn't qualify for a reduced sentence if they've previously received an alternative misdemeanour sentence or have been convicted of certain felony-level offenses in the past three years. Vehicle theft is an example of a Level 6 felony. (Ind. Code Ann. § 35-50-2-7 (2019).)

B) is : (b) This section does not apply if a person disseminates, displays, or makes available the matter described in subsection (a) through the Internet, computer electronic transfer, or a computer network unless:

(1) the matter is obscene under IC 35-49-2-1 ;

(2) the matter is child pornography under IC 35-42-4-4 ;  or

(3) the person distributes the matter to a child less than eighteen (18) years of age believing or intending that the recipient is a child less than eighteen (18) years of age.
