Did ABC breach its own content licensing policy for political advertising and messaging?

Did the ABC breach its own policies around use of its content in political advertising and messaging by granting permission for the Yes campaign to use some of it's footage in a recent commercial featuring a John Farnham song or did the advertising company use footage without the permission of the ABC?
It seems like a mystery but when you look into it, it looks like ABC may have broken its own policies around the use of its content.
