On the morning of January 1, 2023 (New Year’s Day) around 7:15 AM, Red Bank Police were called to the scene of a motor vehicle accident at the intersection of Newman Springs Road and Hance Avenue westbound. When Patrolman Ashon Lovick of the Red Bank Police arrived on scene, he noticed that a Honda sedan had struck the traffic light stanchion while the airbags had been deployed inside the vehicle. The driver, 18-year-old Diana Olivares, was asked by Patrolman Lovick what happened and where she was coming from. When she was evaluated by EMS, she declined further medical attention and did not wish to go to the hospital.

Diana told Patrolman Lovick that she was coming from Freehold, and admitted to consuming alcohol earlier. Patrolman Lovick afforded Diana an opportunity to perform field sobriety exercises. The first exercise involved the Horizontal Gaze Nystagmus (HGN). The second exercise was the Walk and Turn test, and Diana was unable to walk a straight line while performing this test. The final exercise was the One Leg Stand test, and Diana was unable to count properly or maintain her balance during this test.

Based on her admission to consuming alcohol earlier, the occurrence of a car wreck, and her inability to perform the field sobriety exercises, Diana was arrested for driving under the influence. She was transported to Red Bank Police HQ, where she was afforded an opportunity to take a breathalyzer test. While the Alcotest results indicated a BAC of 0.042%, the results were still over the legal limit for someone under the age of 21. After Diana was processed at police HQ, she was released to a friend after he signed the Potential Liability Warning form on hear behalf. She was issued the following summonses: Operating under the influence, underage DUI, reckless driving, and traffic on marked lanes
