Chautauqua County Sheriff's Office is investigating a serious accident involving an suv and bicycle. The crash happened Tuesday afternoon in Brocton on Route 20. According to Chautauqua County Sheriff, Joseph Gerace, the bicyclist rolled right out in the path of the 27-year old driver. The 15-year old is in the hospital tonight fighting for his life. Deputies say the teen was not wearing a helmet. Under New York State Law bicyclists are only required to wear helmets up to the age of 14. Investigators have no reasons to believe the driver was speeding. However one witness told 7 Eyewitness that she believes the driver was going over the speed limit. Now that it's summer, the sheriff fears more of these accidents could happen if cyclists and drivers don't safely share the road. "Bicyclists are out in numbers. They have a right to the road. We have to slow down and give them access," Gerace said. The sheriff also advise cyclists to wear helmets regardless of their age and dress in bright colors/reflective clothing so drivers can see you. A helmet is what saved the life of former Bisons General Manager, Mike Billoni. Almost 25 years ago a drunk driver hit him from behind while on his bike. He's been pushing to make it law for all cyclists to wear helmets. He's now challenging Western New York lawmakers to take action. " I'll love for Andrew Cuomo, the governor, and our state legislature make a new law. One that everyone should wear a bike helmet. There is so many people riding bikes today, but unfortunately people driving cars are multitasking," Billoni said.
