Realtor Girl Arrested for DUI after Hoboken Car Wreck | Blue Patrol Bodycam

At approximately 6:52 PM on the evening of December 26, 2021, Officers Bianca Arroyo and Brandon Fitzgibbons were dispatched to the site of a motor vehicle accident involving multiple vehicles and possible injuries at 618 Bloomfield Street in Hoboken. The driver was identified as Raissa Gislene Restivo, a 34-year-old resident of Boca Raton, Florida. An officer approaching Restivo detected the odor of an alcoholic beverage emanating from her breath, as well as watery eyes and slurred speech. Restivo had already admitted to an officer that she had been drinking earlier in the day.

Based upon their suspicion of impairment, the officers afforded Restivo the opportunity to participate in a Standardized Field Sobriety Test (SFST). At the completion of the Horizontal Gaze Nystagmus (HGN) test, the officer noted that Restivo exhibited Lack of Smooth Pursuit, Distinct and Sustained Nystagmus at Maximum Deviation, and Onset of Nystagmus Prior to 45 degrees in both eyes. The officer also did not observe a Vertical Nystagmus, and Restivo continuously moved her head and failed to follow instructions.

The second test involved the Walk and Turn (WAT) Test. Upon beginning the instructional portion of the test, Restivo was placed in a heel to toe position while the officer demonstrated the test. Restivo proceeded to take 9 steps forward and could not maintain a heel to toe position throughout the course of the test. Restivo continuously failed to follow instructions that were explained to her before the WAT test.

The final test was the One Leg Stand (OLS). After the test was demonstrated for Restivo, she did not have any questions. Restivo began the test, but could not maintain her foot 6 inches off the ground. Also, Restivo dropped her foot down to the ground and could not maintain her balance.

Based on the officer’s observations and Restivo’s inability to properly perform the tests administered, Restivo was informed at approximately 7:12 PM that she was being placed under arrest for Driving While Intoxicated (39:4-50). After she was transported to Hoboken Police HQ, Restivo consented to providing breath samples. Restivo was subsequently transported to the Jersey City Police Department at 365 Summit Avenue to complete the breath test. Restivo’s breath test revealed a BAC of 0.17%, which was more than double the legal limit.

At approximately 8:37 PM, Restivo was transported back to Hoboken Police HQ. At this time, Lieutenant Gonzalez informed Officer Arroyo regarding the particulars in regards to the series of events that took place at the scene. According to witnesses, Restivo was driving at a high rate of speed which resulted in her colliding into a blue colored Chevy Malibu that was partially parked near a fire hydrant. The impact of the crash to the parked vehicle shifted the parked vehicle which then struck the victim Laruen Hardie Vallone as she was standing on the passenger side of the vehicle. Also, due to the impact of the crash, Restivo, who was driving a black Chevy Cruze, elevated the vehicle into the air and turned over, subsequently crashing into a properly parked gray colored Toyota Highlander on the other side of the road.

An ambulance arrived on scene to medically assess Hardie, and she was transported to Jersey City Medical Center (JCMC) for treatment. Officers Bates and Lupo traveled to JCMC to obtain an update regarding Hardie’s injuries. Officers were informed that Hardie had sustained a fractured upper femur to her right leg, and that her hip would need to be “reset” based on the injuries resulting from the crash.

At approximately 10:21 PM, Sergeant Roary Miller contacted Sergeant Ragland of the Hudson County Prosecutors Office – Crash Investigations Unit. Sergeant Miller was instructed by Sergeant Raglan to only process Restivo on Assault by Auto (3rd Degree) due to the totality of the circumstances, and they would only upgrade the injuries to the 2nd Degree crime of Serious Bodily Injury (SBI) if it was appropriate. Restivo was fingerprinted by Officer Fitzgibbons and subsequently issued a Summons for violating Assault by Auto (3rd Degree), along with citations for Driving While Intoxicated and Reckless Driving. After she was processed, Restivo was released to a family member after she signed the Potential Liability Form.
