In this quick tip, the topic of children from prior relationships and second marriages are discussed by Samantha Fitzgerald, Esq.

Most people will want to leave their assets to their spouse in case they die or become incapacitated.

If both parents passes, people typically will want their assets to transfer over to their children.

This requires careful planning.

The assets of the deceased spouse can pass to the surviving spouse or ex-spouse because the survivor was listed as a beneficiary or were owned jointly.

If planning was not done properly, the assets can pass over to the survivor’s children or side of the family if the surviving spouse passes away as well.
