Stand4THEE Press Conference Constitutional Question RE: Quebec Mask Mandate

Bozena Lis and Liliana Gwizdkowska have filed a constitutional question regarding Quebec’s mandatory mask policy Bylaw implemented on June 23, 2021.

Both women have been charged and fined $1,600.00 for not wearing a mask. One of the women, Bozena Lis, who is medically exempt from wearing a mask was physically restrained with handcuffs and a mask was forcibly placed over her mouth by a police officer.

The Constitutional issue is that the mask Bylaw is criminal in nature in that it is prohibitive with sanctions (penalties imposed on those who commit an offence under the Act) in the public interest. This criminal law classification is defined in Canadian criminal case law known as the “Margarine Reference.” The Constitution assigns exclusive jurisdiction for Criminal Law to the federal government under section 91.27. Therefore, this Bylaw is unconstitutional because it is a Provincial Bylaw.

The public will not be allowed to witness the proceedings in person nor via Zoom.
The Attorney General of Quebec will be present on June 15, 2023, to address this constitutional question. This court date also corresponds with the 808th anniversary of Magna Carta of 1215.

“What does the Attorney General of Quebec have to hide and why is he being shielded from public scrutiny by the Court?” asked Bozena Lis.

This case has implications for every province because mask mandates were introduced across Canada. If the mask laws are deemed unconstitutional then all the money that Canadians have paid out in fines for nor wearing a mask will have to be returned to them.
