Attorney Robert Barnes weighs in on Trump’s Indictment.
Treason requires we would be in a war. Everything Trump took was a copy, they have all the original records and they are the President’s records. Attorney – Client Privilege was violated – the chief judge ordered them to testify. There are no Executive Agencies with records independent and beyond the President; There can’t be any Executive Agency with power over the President. Also, Trump was never subpoenaed. The Government did not issue a subpoena to Trump but a Trump organization in a corporate custodial role was subpoenaed. So how can Trump obstruct a subpoena he was not the subject of? Why did the Government not subpoena Trump? Fifth Amendment – he could assert self-incrimination objections and then any attempts to get those records away from him would be another Constitutional violation.
