HOAs and insurance disputes

So let’s pretend that the HOA has a sign, landscaping, or a gate, and somehow you damage it with your car. What happens at that point? Well, first you would get your car insurance company involved. Chances are your insurance company is not going to want to cover the costs the HOA claims it is due. There will likely be a difference that the HOA will come after you for. So what do you do?
You get the insurance company and their lawyers involved to push back against your HOA. The HOA doesn’t get to pick any sign or gate or whatever it is and charge your insurance company for the full amount because you have to factor in depreciation. Just like if you hit and total someone’s ten year old Camry, they don’t get to replace it with a new sports car on your dime.
So tell the HOA that this issue is between them and your insurance company, you are not involved in this.
