Supreme Court Attacks Clean Air Act And Environmental Regulation
US Supreme Court ruled today to narrow the scope of the Clean Water Act, the landmark environmental law that was passed in 1972. The court's decision will make it more difficult for the government to regulate wetlands, which are important for flood control, water quality, and wildlife habitat.
The case, Sackett v. Environmental Protection Agency, was brought by a family who owns land in Idaho that includes a wetland. The family was sued by the EPA after they filled in the wetland without a permit. The family argued that the wetland was not subject to the Clean Water Act because it did not have a direct connection to a navigable waterway.
The Supreme Court ruled in favor of the family, holding that the Clean Water Act only applies to wetlands that have a "continuous surface connection" to a navigable waterway. This means that wetlands that are isolated from navigable waterways, or that are only connected to them by an intermittent stream, will no longer be subject to federal regulation.
The court's decision is a major victory for developers and industries that have long sought to limit the reach of the Clean Water Act. It is also a setback for environmental groups, who argue that the decision will make it more difficult to protect wetlands and other important water resources.
The full impact of the court's decision is still unclear. However, it is likely to have a significant impact on wetlands across the country. It is also likely to lead to more legal challenges over the scope of the Clean Water Act.
