The Legal Fight over “Taco Tuesday”

For decades, restaurants have marketed “Taco Tuesday,” but it is not clear who owns the legal right to the term.
Taco Bell has declared legal war with two smaller companies over the term. Taco Bell, owned by Yum Brands, filed petitions with the patent and trademark office to cancel the trademarks owned by a chain called Taco John’s and a New Jersey restaurant. Taco Bell argues that any restaurant should be able to use the term “Taco Tuesday.”
Taco Bell has recruited LeBron James in their efforts to liberate the term “Taco Tuesday.”
Since the 80’s, Taco Tuesday has been trademarked by Taco John’s in the Midwest, and Gregory Restaurant & Bar in New Jersey. These two companies will send cease and desist letter to other restaurants that use the term.
My friends, no restaurant is safe to use this common term. This is an outrage to taco lovers everywhere. Everyone should be able to use the term freely without fear of being sued.
