An exculpatory witness has emerged in the case against Daniel Penny, the Marine Subway hero that’s facing manslaughter charges for rescuing passengers from crazed and violent Jordan Neely. The witness, who apparently filled out a police report, claimed Penny did all he could to avoid Jordan Neely until it was impossible to do so because he began threatening passengers. She quotes Neely as saying “I would kill a motherf-er. I don’t care. I’ll take a bullet. I’ll go to jail.”The witness also claims that several passengers took video of the incidents and threats leading up to Penny subduing Neely and she hopes they come forward. She was shocked to find out Penny was being charged by Alvin Bragg, who had to have known that Jordan Neely had been placed on the top 50 list of homeless people in NYC.
