Halyna Hustchins, Joel Souza and Alec Baldwin were both shot on October 21, 2021 with a weapon that Alec Baldwin was holding while they were filming Rust in New Mexico. Hutchins was killed by the gunshot. Souza survived. Baldwin has insisted that the gun wasn't loaded and that it was "cold"; he also claims that he didn't believe he pulled trigger. Baldwin, and others on Rust, were always criminally negligent in my eyes. However I did not believe that Baldwin intended to hurt anyone. This was an accident caused by negligence, incompetence, and misinformation. Baldwin was charged with involuntary murder by a New Mexico prosecutor in January, almost three months earlier. These charges have now been dropped. New Mexico prosecutors have dropped the involuntary murder charges against Alec Baldwin that were brought for the shooting death of a cinematographer on the set "Rust", who died when the gun he used to practice with went off. An official who spoke anonymously about the case said that a new team took over the case after which they reviewed new evidence. This showed that the gun that Mr. Baldwin had been practicing with was modified before being delivered to the set. The official explained that this evidence undermined the prosecution's initial argument that the gun couldn't have fired without Mr. Baldwin pulling the trigger. Mr. Baldwin has always maintained that he didn't pull the trigger, even though he was told that day on the set the gun had no live ammunition. He also claimed to investigators that the gun went off when he pulled back the hammer and let it go. The original prosecutors said the F.B.I. The analysis of the weapon showed that the shooter must have pulled it, and this was a factor in their decision to file charges. Luke Nikas, one of Mr. Baldwin's attorneys, and Alex Spiro issued a joint statement saying, "We welcome the decision to dismiss this case and encourage an investigation into the circumstances and facts surrounding this tragic accident." Hannah Gutierrez Reed, the film armorer who was in charge of weapons and loaded the gun on the day of shooting, was charged in this case with involuntary murder. Jason Bowles said that she had informed him of the decision of the prosecutors to dismiss the case. However, the charges against Gutierrez Reed remained. The New York Times The charges against Gutierrez Reed remained ..." good. Gutierrez Reed was the person most responsible for the Rust set according to almost all accounts and investigations. She was the armorer and was responsible for all the weapons. She also had to make sure that no one gave Alec Baldwin a gun with a hair-trigger loaded. I have said it before, but I don't think Baldwin is not criminally or legally liable. He was the producer of Rust and was in charge of production. In a broader sense, he had managerial responsibility. Manslaughter, however, was never a realistic option. We won't be getting a Hilaria-Baldwin courtroom telenovela then, are we? We'll have to remember fondly her impromptu press conference in Mexican accent on the street after her husband had been charged. Alec shared this IG post shortly after the news broke (Luke was his lawyer). See this post on Instagram Alec Baldwin shared a post (@alecbaldwininsta). Backgrid ABC provided the photos.
