MN Gun Owners Caucus: Privately manufactured firearms & serial numbers

We have an important advisory for gun owners in Minnesota who possess privately manufactured firearms or other non-NFA firearms that do not have a serial number.

Minnesota statute 609.667 makes possessing a firearm not identified by a serial number illegal, referencing the National Firearms Act, which requires certain firearms, such as machine guns, to be registered and serialized.

Violating this law is a gross misdemeanor, punishable by up to one year in jail and a $3,000 fine.
*BUT* some overzealous prosecutors in Minnesota have begun using this statute to prosecute anyone possessing ANY firearm that does not have a serial number – even those that do not require a serial number under federal law.

We believe the County Attorneys deciding to prosecute those possessing privately manufactured firearms are misinterpreting this statute. They do not appear to understand the complex patchwork of laws and regulations involved.
