POLICE ID REQUEST FAILURE by Cst. ERBES. "DRIVER" MVAR & Reasonable Articulable Suspicion Of Crime
Cst. Conrad ERBES doesn't know MOTOR VEHICLE ACT REGULATIONS - Interpretation "DRIVER" & "OWNER"
"DRIVER" means a person who drives or is in actual physical control of a vehicle.
"OWNER", with respect to a vehicle, means the person who holds the legal title to the vehicle.
"CAMPER" means a structure designed to be mounted upon a motor vehicle
A police officer can not require your DL if you are not the "DRIVER" of a motor vehicle on public property. A police officer also can not require Identification from anyone in public without reasonable articulable suspicion that an individual committed a crime.
Note: Erbes had no reason to suspect me of a crime to ask/require ID, and I was not the “driver” as I was in the “camper.” He could have written MVA/MVAR violation tickets to the registered owner of the vehicle. He could have asked me to move without any threats, left the scene and come back later to verify I left the scene.
