In this video, we'll be discussing the Fair Use Act and how it applies to educational purposes. The Fair Use Act is a provision in U.S. copyright law that allows for the limited use of copyrighted materials without permission from the copyright holder. This provision is intended to promote creativity, innovation, and free speech, while also protecting the rights of copyright holders.
When it comes to educational purposes, the Fair Use Act allows for the use of copyrighted materials in certain situations, such as for classroom instruction, research, criticism, and commentary. However, there are limitations to how much of the copyrighted material can be used and for what purposes.
In this video, we'll break down the four factors of fair use: the purpose and character of the use, the nature of the copyrighted work, the amount and substantiality of the portion used, and the effect of the use on the potential market for or value of the copyrighted work.
We'll also provide examples of how the Fair Use Act applies to educational settings, such as using short clips of a movie in a film studies class, using a portion of a book in a literary analysis, or using a copyrighted image in a PowerPoint presentation.
