IRNIE's quick synopsis before the reschedule traffic court with ERBES March 29, 2022. "Your Worship I request Full Dismissal based on (5) illicit reasons / infractions by Cst. ERBES:
1) Malicious intent to intimidate or threaten the defendant and witness
Dec 14, 2022 – 5 Min before court, just outside that door ERBES asked me how I was going to plea? IRNIE "Not Guilty"
ERBES: “In that case I'm issuing additional tickets, you have been served!”

73(2) Fail to state name and address MVA

ERBES also included a threatening letter with the Violation ticket he just served (In Official Police Capacity), The personal letter was a direct threat to the defendant and witness outside your court room. Written and signed personally by Conrad Erbes a “Cease and Desist” notice - seeking monetary funds at 1000$ per day, for every day the video evidence from January 29, 2022 remains online. The defendant and witness felt intimidated and threatened by ERBES just before and during your court room on Dec. 14, 2022, your Worship. The trial was re-scheduled due to time constraints to today, March 29, 2023.

ERBES has not maintained the RCMP High Professional Standard, Code Of Conduct, and is currently under investigation by RCMP instigated by CRCC for “Neglect Of Duty, Oppressive Conduct and Improper Attitude.”

2) Have not been given FULL DISCLOSURE:

I have requested Full Disclosure for this court case Violation Ticket AJ24625678 in writing and submitted to RCMP Kelowna front desk December 5th, and December 19 2022, and followed-up by phone leaving messages Dec 15, Jan 9, Jan 14.

Note: January 14, ERBES direct supervisor Staff Sgt. Abels had Cpl. Martens call me and tried to circumnavigate my request for Full Disclosure, with ERBES sitting beside him I believe.

Cpl. Martens said “we do not make a habit of just giving out disclosure, that is something that has to be done through the freedom of information... We don’t give out disclosure.”

I responded: “in terms of my tickets that I got from Conrad Erbes, I am entitled to full disclosure for that court proceedings.”
Cpl. Martens - “Absolutely”

ERBES only gave me his copy of the Violation ticket and his SYNOPSIS-1.

ERBES in his SYNOPSIS stated:
“The vehicle had been observed by CCTV monitored during the day...”

“The commissionaires explained that the male had been causing disturbance throughout the day...”

“Commissionaire witness [REDACTED] provided a detailed security report to police.”

On January 29, 2022 ERBES stated he was responding to a complaint, but when asked “What is the complaint?” he responded, "you are unwelcome here.”

We are also requesting any and all information in relation to the “RE: Cease and Desist Notice Letter” by Conrad Erbes.

3) ERBES interfered with my process to appeal the original violation ticket AJ24625678 from Jan 29, 2022.

Erbes crossed out Count (1) on my violation ticket copy, but not on his copy.

I had to attend Kelowna Court house to file a late dispute with affidavit giving reason to do so.

January 29, 2022 violation tickets with 2 legible counts.
I filed Notice of dispute Feb 28, 2022 (3.011 and 4.20)
April 27th 2022, at Autoplan discovered a ticket owing.
May 2, 2022 Affidavit at Kelowna Court House for request for late dispute with Judicial Justice.

4) ERBES has never identified the defendant with Government issued ID

*ERBES wrote the violation ticket AJ24625678 indicating IRNIE as the “DRIVER.”
Note: IRNIE is the motor vehicle OWNER, and was never in the motor vehicle for the full three-hour detainment and harassment by Conrad Erbes.

IRNIE was in the “CAMPER” for the entire ordeal.

5) ERBES refused to identify. The defendant had to call the police to Identify Cst. ERBES by his car number. RCMP are required to Identify upon request for the safety of citizens and police."
