Nais kong magsampa ng kasong Unjust Vexation laban sa aking kapitbahay. Dahil dito, nais kong malaman kung anu-ano nga ba ang mga nararapat na maipakita at mapatunayan sa aking ikakaso? – Andrei
Dear Andrei,
Para sa inyong kaalaman, nakasaad sa Article 287 ng ating Revised Penal Code of the Philippines na sinusugan ng Republic Act No. 10951 noong 2017 ang batas tungkol sa Unjust Vexation, viz:
“Art. 287. Light coercions. - Any person who, by means of violence, shall seize anything belonging to his debtor for the purpose of applying the same to the payment of the debt, shall suffer the penalty of arresto mayor in its minimum period and a fine equivalent to the value of the thing, but in no case less than Fifteen thousand pesos (₱15,000).
“Any other coercions or unjust vexations shall be punished by arresto menor or a fine ranging from One thousand pesos (₱1,000) to not more than Forty thousand pesos (₱40,000), or both.”
Bagama’t hindi binanggit ng batas ang eksaktong depenisyon ng kasong Unjust Vexation, nilinaw naman ng Korte Suprema sa kasong Maderazo vs. People (G.R. No. 165065, September 26, 2006), na isinulat ni Honorable former Associate Justice Romeo J. Callejo, Sr. na ito ay:
“The second paragraph of the Article is broad enough to include any human conduct which, although not productive of some physical or material harm, could unjustifiably annoy or vex an innocent person.”
Alinsunod sa nabanggit na depenisyon ng batas, kinakailangan ninyong mapatunayan ang mga sumusunod na elemento ng krimeng ito:
Mayroong hindi makatarungang gawain na nakaka-annoy o nakakairita sa kapwa o ibang tao;
Ang akto o asal na ito ay hindi sinamahan ng karahasan;
Ang akto o asal na ito ay dahilan ng pagka-annoy, pagkairita, paghihirap, pagkabalisa o kaguluhan sa pag-iisip ng taong tumanggap ng akto o asal na ito; at
Ang maysala ay umakto nang mayroong intensyong kriminal.
Ang nasabing pagpapaliwanag ng Korte Suprema noong 2006 ay makabuluhan pa rin sa kasalukuyang batas dahil pinataasan lamang ng R.A. No. 10951 ang magiging multa sa mapapatunayang nagkasala ng unjust vexation.
