This story really struck a chord with me because it perfectly exemplifies the inherent complexity of self-defense shootings and how unfair it is for legal gun owners who simply want to protect themselves and their property.
I recently installed a system on my truck that alerts me immediately if someone is tampering with it. So, if I receive a notification that someone may be trying to steal my truck, I will naturally go outside to investigate, and because I almost always carry a gun, I will have it on me.
However, the question remains: at what point is it legally okay to use my gun in self-defense? In the scenario where two guys are trying to steal my truck and one of them has a gun, is my life in danger enough to use deadly force to protect myself?
To my knowledge, Texas is the only state that has a law allowing deadly force to defend movable tangible property, and even then, it must be at night.
Generally speaking, we can't just start shooting at someone trying to steal our property. But if the criminals also have guns, the situation becomes even more complicated. Simply having a gun doesn't automatically justify the use of deadly force.
There are many factors that can come into play, which can make our actions justified or unjustified.
It's incredibly frustrating because as legal gun owners, we already have so much to worry about when it comes to defending ourselves. Now, we also have to become legal scholars and make complex analyses in what will likely be one of the most terrifying experiences of our lives.
Criminals, on the other hand, can act without thinking.
They can just start shooting, whereas we have to make legal decisions in an instant.
It's truly messed up how a criminal can force us to make a decision that could land us in jail or sued into eternity, even though we were just trying to protect ourselves and our property.
The only thing we can do is educate ourselves as much as possible, so that if the day ever comes where we have to make these complex split-second decisions, we can be better equipped to do so. I always recommend getting some type of concealed carry insurance, such as a USCCA membership.

I work with USCCA because they don't just offer insurance; they also provide training and a lot of information about how to deal with situations like this from actual lawyers who do this for a living. To me, that information is invaluable because it can put us ahead of the game if we ever find ourselves in a self-defense situation that isn't exactly cut and dry.
