Software Audit Letter Explained

When your business receives a letter from a law firm demanding you participate in a "voluntary" audit and setting forth the NOT SO SUBTLE suggestion that any infringed products could cost you $150,000 per pirated copy, most people freak out, and wonder if this is a scam.

In this video, software lawyer Steve Vondran, Esq. provides a brief overview of what the letter is, what it says, and what it might mean to your company.

If you are facing an audit here are some basic general tips:

1. Call a copyright lawyer BEFORE you call them. They may be tape recording your phone call and the information you give them may be used against you.

2. Do not panick. These are not "mandatory" audits, they are voluntary. If you are dealing with the software alliance, or the SIIA, these are indistry trade groups and NOT law enforcement. So you have time to look into this and figure it out. We can help you get an extension of time to respond to these letters.

3. Start gathering receipts and proofs of purchase so you have an idea of your licensing ownership position. This is helpful for when you contact us, so we have a general idea of what you are short.

4. Do NOT TALK TO ANYONE about this. Anyone you talk to could later be called as a witness if a federal copyright infringement lawsuit is filed.

TIP: most cases do NOT result in a lawsuit, but you have to be very careful about how you handle your case.
