NAVIGATING DOMAIN NAME DISPUTES IN THE UNITED STATES

The Uniform Domain Name Resolution Policy (UDRP) is a process established by the Internet Corporation for Assigned Names and Numbers (ICANN) for the resolution of disputes concerning the registration of internet domain names. The UDRP is governed by WIPO and is available to any party with a legitimate claim to a domain name.

The first step in the UDRP process is filing a complaint with WIPO. The complaint must allege that the domain name in question is identical or confusingly similar to a trademark or service mark in which the complainant has rights, that the respondent has no rights or legitimate interests in respect of the domain name, and that the domain name has been registered and is being used in bad faith.

Once WIPO receives the complaint, it will notify the respondent and provide them with an opportunity to file a response. The respondent may assert one or more defenses in their response, such as that they have rights or legitimate interests in respect of the domain name, or that the domain name was not registered and is not being used in bad faith.

After both parties have had an opportunity to be heard, WIPO will issue a decision. If WIPO finds in favor of the complainant, it will order that the disputed domain name be transferred to the complainant. In cases where WIPO finds that the disputed domain name was registered and is being used in bad faith, it may also order that the domain name be suspended or canceled.

While UDRP decisions are not enforceable in court, they can be used as evidence of bad faith registration and use under ICANN's Registrar Transfer Policy (RTP) or Uniform Domain Name Dispute Resolution Policy (UDRPDRP). In addition, UDRP decisions may be enforced under ACPA if certain conditions are met. As a result, UDRP decisions can have a significant impact on internet domain name disputes.
