FACING A REAL ESTATE BOARD HEARING? HERE ARE SOME GENERAL TIPS!

Attorney Steve, the real estate lawyer, shares his real estate ethics hearing tips with complainants and respondents in California. There are many things that have to be considered when handling these types of cases. For example:

1. Make sure you are prepared

2. Have all relevant transaction documents

3. Call all your witnesses (prep them) and ask them to show up

4. Be prepared that other agents will lie (have rebuttal evidence ready)

5. Make sure to get your objections on the record

6. Make a strong opening and closing statement

7. Raise all claims and defenses

8. Make sure all the violations of the N.A.R. code of ethics are proven by "clear and convincing evidence"

9. Be courteous to the panel members (they are volunteers and probably have not had a ton of time to dive into all the nitty-gritty details of your case)

10. Relax, enjoy your day in Court and realize this will not be the end of the world.
