Can you get your real estate license if you have a criminal conviction?

Criminal convictions can present a huge problem when you are seeking to apply for a California real estate license. Attorney Steve Vondran, the real estate lawyer, discusses this important topic in his top 10 frequently asked real estate compliance video series.

If you have a felony or misdemeanor criminal conviction in your background, even if it was expunged, you should seek counsel to represent you. The toughest cases are criminal convictions for fraud, burglary, domestic violence, multiple DUIs (for example "extreme DUI"), murder, assault, battery, rape, and other crimes that the BRE or DRE might believe are "substantially related to the day-to-day duties, qualifications, and functions of real estate practice."

An experienced California real estate defense lawyer can assist you in making the case that you deserve a real estate license. We can represent you in your hearing and present a package to the Bureau showing your rehabilitation factors.

If you get a "statement of issues" or a real estate "accusation" I would respectfully urge you NOT to go it alone and NOT to start communicating with phone calls and letters to the BRE or its team of auditors, investigators, or attorneys.

We have had too many people in the past tell us "they seemed really nice and told us this is not a big deal, and that we don't necessarily need a lawyer." While this might be tempting to save a few bucks by not having to hire real estate counsel, you can end up making costly admissions that you cannot later back out of if there is a hearing. In other words, you should take the time to plan your response in advance.

One of the big areas that pop up is failing to disclose your prior convictions on the application.
