The Uniform Domain Name Dispute Resolution Policy (UDRP) is a process established by the World Intellectual Property Organization (WIPO) for the resolution of disputes over the registration of domain names. The UDRP is available to trademark holders who believe that their rights have been infringed by the registration or use of a domain name.

The UDRP process begins with the filing of a complaint with a WIPO-approved dispute resolution provider. The complaint must allege that the domain name in question is identical or confusingly similar to a trademark or service mark in which the complainant has rights, that the respondent has no rights or legitimate interests in the domain name, and that the domain name has been registered and is being used in bad faith.

Once a complaint has been filed, the respondent has an opportunity to file a response. WIPO-approved dispute resolution providers will then appoint a panel of one or three experts to review the case and render a decision. If the panel finds in favor of the complainant, it can order that the disputed domain name be transferred to the complainant or cancelled. In some cases, panels have also ordered that domains be suspended pending resolution of the dispute.

Under the Anticybersquatting Consumer Protection Act (ACPA), trademark holders can also bring civil claims against domain name registrants who they believe have engaged in cybersquatting – that is, registering, selling, or using a domain name with bad faith intent to profit from someone else’s trademark. Cybersquatting cases brought under ACPA are usually decided by courts, rather than through WIPO’s UDRP process. However, WIPO’s UDRP process can be used as evidence in an ACPA claim.
