A notary in California takes an oath of office. The oath requires the notary to keep and maintain a notary journal and the notary seal. These must be kept in exclusive control of the California notary. Failure to keep these basic controls can result in losing the notary license or going after the bond. We have sent demand letters to California notaries demanding that they produce their journal entries (also a legal requirement under California notary law) and we have taken the deposition of notaries that cannot seem to get they job done.

Many times, notary fraud is indicative of a bigger issue - such as financial elder abuse, securities and investment fraud, or other types of legal violations. With the economic crises in full force, you can no longer assume a notary stamp is valid. You have to demand proof that that notary did their job properly and were not in on the deal.
