WHAT IS THE "STATUTE OF FRAUDS"? FOR STARTERS, IT IS A POTENTIAL WAY TO WIN YOUR LAWSUIT.

In this episode, Attorney Steve Vondran shares his tips for breach of contract arbitration and litigation. Specifically, the "statute of frauds defense."

The gist of the law in California is that CERTAIN contracts, by statute (California Civil Code section 1624) have to be in WRITING to be enforceable. Some courts allow "tacking" to meet the wiring requirement.

If the contract is REQUIRED to be in writing but is NOT in writing, then the courts may find the contract to be unenforceable (meaning Plaintiff loses the case).

There are certain exceptions to the SOF such as:

1. Fraud

2. Promissory estoppel - justifiable reliance

3. Completed (executed oral contract)

and

4. Part performance of an oral contract.
