Malibu Media Defense Lawyer discusses BIG Defendant win in Illinois

In this exciting episode of Copyright Watchdog®, Attorney Steve® discusses one big win for Defendant in Northern District Court in Illinois dealing with an allegation of the illegal download of 24 movies in which Plaintiff, Malibu Media, was seeking approximately $18,000 in monetary damages for copyright infringement.

Both Plaintiff and Defendant filed motions for summary judgment, and the magistrate judge sided with Defendant, finding that a subscriber's IP address alone is not proof of infringement and Plaintiff failed to prove that Defendant had downloaded copyrighted content (no proof of copying), and there was no triable issue of fact to send the case to trial.

Now, this court case took a long time to fight in federal court, but it does show a Plaintiff needs to bear the burden of proof to show direct copying or some access to copyrighted content, and where they cannot, the Defendant might be able to prevail.
