WHAT IS A LIS PENDENS

When you are involved in a real estate lawsuit, you might need to file what's known as a "lis pendens" which basically means "litigation pending." Attorney Steve discusses some of the finer general points of the process of filing a lis pendens including:

1. Filing the notice with the County Recorder's office

2. Legal requirements for a lis pendens

3. What is "clouding title?"

4. Does "slander of title" come into play?

5. Does "title or possession" to real estate come into play?

Watch this video to learn the basic of recording a lis pendens. A lis pendens provides "constructive" notice to the public of a pending lawsuit. The buyer of the property would buy the risk of a lawsuit. Usually, the property title has to be at issue. One good example, is where an elder in California is subject to financial elder abuse (signed over the title to the kids or a caretaker), and you need to "lock-up" the property so any potential buyer would be on notice of the list Pendens, then, if the elder succeeds in the case they can argue the buyer has inferior legal rights and seek to regain title and ownership to the property at issue.
