Supreme Court to hear key Copyright case

Fourth Estate Public Benefits vs. Wall-Street.com

There is a split of authority across the federal courts of the United States over when you are able to file a copyright infringement lawsuit. We know that there must first be application made to the United States Copyright Office (“USCO”) and its only about $55 bucks, but can you file an application after you file the registration form, pay the fee, and submit the sample (ex. song, video, software, movie, photo), or must you wait until the copyright certificate issues before you can file a federal court lawsuit seeking money damages?

The Supreme Court of the United States (“SCOTUS”) has granted “writ of certiorari” to hear this important issue of intellectual property law.
