What does the legal term "En Banc" mean?

In this episode Attorney Steve® discusses the legal term “en banc” and provides a general working definition. Basically it is a tool to have your case re-heard by all of the federal judges in the district. If you lose a case on appeal, you can seek a rehearing en banc (which is French for “on the bench”). You want to get all the judges on the bench either because:

1. Stare decisis was not followed (ex. The appellate court ruled improperly with respect to existing case law)

2. There is an important public issue at stake worthy of having the entire bench assemble to hear the matter.

The process is governed by Federal Rules of Appellate Procedure Rule 35 (F.R.A.P. 35(a)).

The other option is filing for a writ of certiorari to have the United States Supreme Court (the “Court of last resort” as we call it) hear your case. This is basically an appeal of the appellate court decision.
