"Pepe the Frog" Copyright fair use case overview by Attorney Steve

In this video copyright counselor Attorney Steve® discusses the “Pepe the Frog” case which has many people interested. In this case the creator of Pepe the Frog is suing Infowars for allegedly misappropriating and infringing his copyrights in the happy-go-lucky reptile. The infringement lawsuit has been filed in the federal district court in the Central district of California. From what I could tell it was only in the “discovery” stage of the lawsuit so this one could go on a while. Here at Copyright Watchdog® we will keep you posted with updates from the Court. Defendant has argued “fair use” and “de minimis” use and copyright abandonment among other things and have argued that the poster they were selling online which featured Pepe was “transformative” in nature and thus protected like a parody.
