"FOSTA" sex trafficking law discussed by Attorney Steve

Congress, both the house and senate, recently passed a bill known as HR 1865. This bill is known as the Fight Online Sex Trafficking Act ("FOSTA").

This bill has been criticized by organizations such as the Electronic Frontier Foundation ("EFF"), American Civil Liberties Union ("ACLU"), and the Center for Democracy and Technology. The United States Department of Justice has also issue a concern in a letter to Congress.

The aim of the law is to cure sex trafficking as it may be promoted or facilitated online. However, this may also curb some constitutionally protected free speech.

For example, lawful and consensual "sex workers" (ex. escort services), and even interactive computer services like Craigslist that has "personal ads" (ex men seeking women, men seeking men, etc.).

The new law, if signed by President Trump, would expand federal prostitution law, and put the burden on internet platforms to police their sites (and probably change their terms of service) in order to make sure they do not get sued in civil court, or face criminal charges. In response, I have learned that Craigslist has shut down its online personal ads due to litigation liability concerns.

So this may be an example of good intentions making bad law and prohibiting what in most cases is legitimate free speech, and the ability to meet and connect with other people in a lawful manner.

We will see if President Trump signs the bill into law.
