IS IT LEGAL TO EMBED THIRD-PARTY PHOTOS ON YOUR WEBSITE?

In this episode of Copyright Watchdog, Attorney Steve discusses the Goldman v. Breitbart et al. copyright infringement case dealing with the posting (embedding) the Tom Brady photo in the Hamptons on various news sites. The photo was not hosted on the Media Defendant servers but was "embedded" to link back to the Twitter page where the photo was hosted.

The New York District Court judge did not go along with the 9th circuit test of infringement (the "server test" as set forth in Perfect 10 v. Amazon) and instead found the embedding to violate the exclusive right of the copyright holder (Mr. Goldman who took the photo) and the public display right.

So this creates a split between the 9th Circuit (ex. California) and the East Coast (New York).

The case did discuss some potential defenses that any facing a copyright infringement action for sharing Twitter feeds should consider, namely:

1. DMCA safe harbors (for online service providers)
2. Fair use (ex., news and commentary)
3. Innocent infringement
4. Plaintiff released the photo into the public domain.
