I promised to follow up on Torrent cases post-Cobbler Nevada case. Here is a case from the Eastern District of California where a “John Doe” Defendant sought to quash a subpoena based on the Cobbler Nevada holding. The Court did not go for it but mentioned that innocent parties may file a motion to dismiss and cautioned Plaintiff's counsel regarding Rule 11 for naming parties without just cause (relying on the Cobbler Nevada case).
