Photo Infringement FAIR USE of internet photo

This BIG FAIR USE case comes from the Eastern District Federal Court in Virginia (Alexandria Division). The case is BRAMMER v. VIOLENT HUS PRODUCTIONS, LLC.

In this case Brammer (the photographer) had a registered copyright to a time lapse photo of Washington D.C. skyline (portion of the area). He had licensed the photo a few times but was not apparently active in doing so. The image was posted online as early as 2012.

When the photographer saw his image being used on a Virginia Film Festival page ("things to do") a cease and desist letter was sent.

Presumably, the case could not be settled and a lawsuit was filed alleging copyright infringement. The defendant argued that they did not see a copyright symbol on the image and did not know it was subject to copyright (an argument we hear quite often - "I found the image on google."

The court applied the Fair Use 4 factor test (as should be done when a Defendant is alleging fair use defense) and determined that the use was proper, and thus, not a copyright infringement.
